HARASSMENT DEFINED
For the purpose of this policy, harassment is defined as unwelcome or
unwanted conduct based on or involving an individual’s race, religion,
gender, color, national origin, protected age, disability, sexual orientation,
physical traits, marital status, citizenship, veteran or military status, or any
other discriminatory criteria when: (1) submission to or rejection of this
conduct by an individual is used as a factor in decisions affecting hiring,
evaluation, training, promotion, demotion, wages and other forms of
compensation, transfer, work hours, assigned duties, or any other terms or
conditions of employment or career development; or (2) the conduct has the
purpose or effect of unreasonably interfering with an individual’s employment by creating an intimidating, hostile or offensive working environment. This definition includes many forms of offensive behavior.
It is inappropriate for anyone of any gender or sexual orientation to sexually harass another person of a similar or different gender or orientation. Sexual harassment on the job is viewed as unlawful whether it involves co-worker harassment, harassment by a supervisor, or harassment by persons doing business with or for TMCF as a contractor or other agent.
Thus, with respect to harassment, TMCF prohibits, among other things: (1) verbal, non-verbal, or physical conduct of an offensive nature or based upon the above criteria, that: (i) has the purpose or effect of creating an intimidating, hostile or offensive work environment; (ii) has the purpose or effect of unreasonably interfering with an individual’s work performance; or (iii) otherwise adversely affects an individual’s employment opportunities. Harassing conduct includes, but is not limited to epithets, slurs, or negative stereotyping; threatening, intimidating or hostile acts; teasing; denigrating jokes and display or circulation in the workplace of written or graphic material that denigrates, ridicules, or shows hostility or aversion toward a protected category (including via email).
This behavior is unacceptable in the workplace as well as in other work-related settings, such as business trips or business-related social events.
