CONTINUING BENEFIT PLAN COVERAGE (COBRA)
All active, full-time team members covered by the Insperity Group Health Plan or the Insperity Health Care FSA Plan may continue plan coverage for up to 12 weeks during an approved leave of absence, or as required by law.
While on leave, team members must continue to pay any required
contributions for health coverage, as well as make payments for any other
applicable benefits that would otherwise be automatically deducted from
the team member’s wages (e.g., supplemental life insurance, credit union loans, 401(k) loans). Team members who
do not return from leave may be required, under certain circumstances, to reimburse Insperity or TMCF for any health plan team member contributions paid by Insperity or TMCF while the team member was on unpaid leave. If a team member does not return to work upon expiration of the applicable 12-week period or longer as required by law, coverage will terminate and the team member will have the opportunity to continue coverage for a limited period under COBRA in accordance with applicable law, starting at midnight of employee’s last day worked.
FAMILY MEDICAL LEAVE ACT (FMLA)
TMCF will grant FMLA in accordance with the requirements of applicable state and federal law in effect at the time the leave is granted. No greater or lesser leave benefits will be granted than those set forth in the relevant state or federal laws. Team members should contact their supervisor and complete a leave of absence request form as soon as he or she becomes aware of the need for FMLA. The following is a summary of some of the relevant provisions. However, there are differences between federal and state (or District of Columbia) laws and so what follows is only a general summary and may not be completely accurate depending on individual circumstances and workplace location.
Team Member Eligibility: To be eligible for FMLA benefits, you must: (1) have worked for TMCF for a total of at least 12 months; (2) have worked at least 1,250 hours over the previous 12 months; and (3) work at a location where at least 50 team members are employed by TMCF within 75 miles.
Leave Available: Eligible team members may receive up to a total of 12 weeks of unpaid leave during a 12-month period. The 12-month period is measured backwards from the date a team member uses federal FMLA.
Leave may be used for one or more of the following reasons: (1) for the birth or placement of a child for adoption
or foster care; (2) to care for an immediate family member (spouse, child, or parent) with a serious health condition;
or (3) to take medical leave when the team member is unable to work because of a serious health condition, and
any other type of leave recognized under the FMLA Act. Under some circumstances, team members may take FMLA intermittently, which means taking leave in blocks of time, or by reducing their normal weekly or daily work schedule. Certain restrictions on these benefits may apply.
