 OUTSIDE EMPLOYMENT
Team members may hold outside employment and be involved in outside ventures as long as they continue to meet the performance standards of their position with TMCF. All team members will be judged by the same relative performance standards, albeit as measured by the demands of their position
with TMCF. However, outside employment that constitutes a conflict of interest
is prohibited. Additionally, outside employment or ventures which may result in competition with or the usurpation of business opportunities naturally belonging to TMCF are similarly prohibited. In this situation, the team member shall have the obligation to disclose such employment, venture or opportunity to the human resources department or the general counsel for review. Following disclosure,
the employment, venture or opportunity will be assessed for the existence of an actual conflict, and if no conflict is found, the team member will be given permission to pursue the same. Engaging in employment or ventures that constitute a conflict of interest or the failure to make the appropriate disclosure may result in disciplinary action, up to and including termination.
If TMCF subsequently determines that a team member’s outside work is interfering with their work performance at TMCF or the ability to meet the requirements of TMCF, as they are modified from time to time, the team member may be asked
to terminate the outside employment if he or she wishes to remain with TMCF. Team members that fail to terminate outside employment that interferes with their work performance at TMCF may face disciplinary action, up to and including termination.
